These Terms of Service ("Terms") govern your access to and use of the SaaS Pulse platform and related services (the "Service") operated by SaaS Pulse LLC ("SaaS Pulse," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You must be at least 18 years old to use the Service.
SaaS Pulse provides a unified SaaS intelligence platform for software businesses, including revenue analytics, multi-touch attribution tracking, support chat, churn prevention flows, feedback boards, and affiliate program management. Features and capabilities evolve as the product develops. We reserve the right to modify, add, or remove features at any time.
To use the Service you must create an account with accurate, current, and complete information. You are responsible for:
You may not share credentials, create accounts on behalf of others without authorization, or use automated means to register accounts.
The Service requires you to connect a Stripe account and may support connections to other third-party platforms. By connecting these accounts, you:
You can revoke connected integrations at any time through your account settings or directly through the third-party platform (e.g., Stripe's Connected Applications). Revoking access does not automatically cancel your SaaS Pulse subscription.
You agree not to use the Service to:
Violations may result in immediate suspension or termination of your account.
SaaS Pulse owns all rights, title, and interest in the Service, including its design, code, features, branding, and documentation. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription term.
Your data (including customer data accessed through connected integrations) remains yours. By submitting feedback, suggestions, or ideas, you grant SaaS Pulse a perpetual, worldwide, royalty-free license to use that feedback without obligation or compensation to you.
The Service is offered on a subscription basis, billed monthly or annually as selected at signup. Subscriptions renew automatically at the end of each billing period unless cancelled.
Our Privacy Policy governs how we collect, use, and protect your information and is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.
If you use the Service to process personal data belonging to your own customers or end users, you are the data controller of that data. You are responsible for:
The Service integrates with third-party platforms including Stripe and others. These platforms operate independently and are governed by their own terms and privacy policies. SaaS Pulse is not responsible for the practices, content, or availability of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. REVENUE AND CHURN INSIGHTS PROVIDED BY THE SERVICE ARE ANALYTICAL IN NATURE AND DO NOT CONSTITUTE FINANCIAL, LEGAL, OR BUSINESS ADVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAAS PULSE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
You agree to defend, indemnify, and hold harmless SaaS Pulse LLC and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) data you provide to or through the Service.
We may suspend or terminate your access to the Service at any time, with or without cause, with reasonable notice where practicable. You may terminate your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. Sections 5, 10, 11, 12, 14, and 15 of these Terms survive termination.
These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Multnomah County, Oregon.
Before initiating any legal proceedings, the parties agree to attempt good-faith resolution of any dispute within 30 days of written notice. The prevailing party in any litigation shall be entitled to recover reasonable attorneys' fees and costs.
We may update these Terms from time to time. We will indicate the date of the most recent update at the top of this page. For material changes, we will provide at least 14 days' notice via email or prominent notice on the Service. Continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
These Terms and the Privacy Policy constitute the entire agreement between you and SaaS Pulse LLC with respect to the Service and supersede all prior agreements, representations, and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
